Mediation provides a relaxed, non-confrontational and safe setting which allows all parties to think, reflect and focus on the behaviour of all concerned.

COST EFFECTIVE

Mediation is cost effective compared to the financial drain of going to court.

TIME EFFICIENT

Mediation can be scheduled within a short timescale. In the case of civil & commercial issues, mediation usually lasts a single day, instead of the months and years involved in court action. Whereas, family matters will be settled over a period of weeks or months as sessions are kept shorter due to the emotive nature of the issues in question.

CONFIDENTIALITY

All discussions and information disclosed during the mediation (with a few legally required exceptions) are confidential. This allows a safe exploration of all the issues of the case.

RELATIONSHIPS

Mediation allows the parties to preserve or rebuild relationships as all sides are empowered to work constructively together to achieve a workable agreement.

This differs from the more hostile legal approach with its 'winner/loser' scenario.                        

In the family setting, ongoing and constructive parental communication, which is paramount when children are involved, is both emphasised and encouraged.

TAKE CONTROL

Mediation allows the participants full control of the process empowering them to decide their own outcome by exploring practical solutions which will benefit all parties.

Self-determined resolutions are better adhered to long term than court-ordered settlements

imposed by judges with little knowledge of the intricacies of the parties' working or daily lives.

FLEXIBLE SOLUTIONS

Mediation provides more than just a financial settlement. Parties are able to design creative solutions ranging from compensation, discounts, a refund, damages, tailor-made asset distribution, to an apology or change in behaviour.

COURTS VIEW

The Courts are increasingly promoting mediation as a mandatory step as early as possible in a dispute, thus deterring the escalation of court action. Penalties have even been considered by judges against parties who unreasonably refuse to mediate.

LITIGATION RISK

There is no such thing as a 'cast iron' case. A judge may not view your case as favourably as you. Furthermore, in the face of a successful ruling you are unlikely to recover all of your legal costs.
